HC US Trademark Ltd. is a debtor-affiliate of MuscleTech Research and Development Inc., which was incorporated under the laws of the Province of Ontario, Canada, on Dec. 5, 1997. MDI is a privately held Canadian company and is the parent company of the other debtor-affiliates.
The other Debtors can be divided into:
(a) Formulation Companies that own or owned certain product formulations, trade secrets, know-how and patents associated with some health supplement, weight-loss and sports nutrition products formerly sold by MDI, and
(b) Trademark Companies that own or owned the trademarks associated with some products formerly sold by MDI and some other miscellaneous trademarks, some of which are Canadian, U.S. or foreign trademarks.
The Debtors are in bankruptcy because of the product liability lawsuits pending throughout the United States against some of the Debtors. MDI already ceased production and sale of products containing ephedra and prohormones in December 2002.
